Welcome to Stevendev Marketing. These Terms & Conditions ("Terms") govern your use of the Stevendev Marketing website, products, services, AI voice agents, and related services.

Stevendev Marketing is a brand of Repeat Customers LLC, a Texas limited liability company ("Stevendev Marketing," "we," "us," or "our").

By accessing our website, purchasing our services, requesting a consultation, or otherwise using our services, you agree to these Terms.

1. Our Services

Stevendev Marketing provides AI-powered voice agent solutions and related services for businesses. Depending on the service purchased, features may include:

• AI-powered inbound and outbound voice agents
• AI receptionist services
• Call answering and routing
• Lead qualification
• Appointment scheduling
• Customer service automation
• Call transfers
• SMS and follow-up communications
• Custom AI voice-agent configuration
• Phone numbers and telecommunications services
• Integrations with third-party software and platforms

Specific features, usage limits, pricing, setup requirements, and other terms may vary by plan or agreement.

2. AI-Generated Communications

Our services use artificial intelligence to communicate with callers and customers.

AI systems are not perfect. An AI voice agent may occasionally misunderstand a caller, provide an incomplete response, make an incorrect statement, or fail to complete an intended action.

Customers are responsible for reviewing and approving the information, instructions, scripts, knowledge bases, business policies, and other materials provided to their AI voice agents.

Stevendev Marketing does not guarantee that AI-generated responses will always be accurate, complete, or appropriate for every situation.

3. Customer Responsibilities

Customers agree to provide accurate and current information necessary to configure and operate their AI voice agents.

Customers are responsible for ensuring that their use of our services complies with applicable laws, regulations, industry requirements, privacy requirements, and telecommunications rules.

You may not use our services for fraudulent, deceptive, abusive, unlawful, threatening, or otherwise prohibited activities.

4. Call Recording and AI Disclosure

Certain services may involve call recording, transcription, automated communications, or interactions with an artificial intelligence system.

Laws governing call recording, consent, disclosure, and artificial intelligence vary by jurisdiction.

Customers are responsible for determining and complying with the laws applicable to their business and callers, including obtaining any legally required consent and providing any required notice that a call is being recorded or that a caller is interacting with an automated or AI-powered system.

5. Outbound Calling and Text Messaging

Customers using our services for outbound telephone calls or text messages are responsible for ensuring that their campaigns and contact lists comply with all applicable laws and regulations, including requirements relating to consent, telemarketing, do-not-call requests, automated communications, and text messaging.

Customers may not knowingly use our services to send unlawful spam, make prohibited robocalls, contact individuals without required consent, or engage in deceptive marketing practices.

Stevendev Marketing may suspend or terminate services that we reasonably believe are being used unlawfully or in violation of telecommunications provider requirements.

6. Third-Party Services

Our services may depend upon third-party providers for telecommunications, artificial intelligence technology, phone numbers, messaging, scheduling, payment processing, hosting, integrations, and other functionality.

We do not control these third-party services and cannot guarantee their continuous availability.

Interruptions, outages, policy changes, carrier filtering, software changes, or other issues involving third-party providers may temporarily affect our services.

7. Service Availability

We strive to provide reliable services but do not guarantee uninterrupted or error-free operation.

Services may occasionally be unavailable because of maintenance, telecommunications outages, internet failures, third-party platform problems, software updates, circumstances beyond our reasonable control, or other technical issues.

8. Pricing and Payment

Customers agree to pay all charges associated with the services they purchase.

Pricing may include:

• One-time setup or implementation fees
• Monthly service fees
• Included usage or minute allowances
• Usage or per-minute charges
• Overage charges
• Phone number fees
• Optional services or integrations
• Custom development or configuration charges

Pricing and usage limits applicable to a customer will be disclosed through the applicable proposal, order, invoice, service agreement, checkout page, or other written communication.

Unless otherwise stated, fees are quoted in U.S. dollars.

9. Usage and Overage Charges

Certain plans include a specified number of minutes, calls, messages, or other usage.

Usage exceeding the amount included in a customer's plan may result in additional charges at the applicable overage rate.

Customers are responsible for charges generated through their account and AI voice agents.

10. Setup Fees

Setup and implementation fees may vary depending on the complexity of the AI voice agent, integrations, workflows, knowledge base, telephone configuration, and other requirements.

Unless otherwise agreed in writing, setup fees compensate Stevendev Marketing for configuration and implementation work and may become non-refundable once work has begun.

11. Recurring Services and Cancellation

Services billed monthly will continue on a recurring basis until canceled in accordance with the customer's applicable service agreement or billing arrangement.

Cancellation stops future recurring service charges after the applicable cancellation becomes effective but does not automatically refund charges already incurred.

Customers remain responsible for outstanding usage charges, overages, setup fees, and other amounts incurred before cancellation becomes effective.

12. Refunds

Except where required by law or expressly stated in a written agreement, payments for completed setup work, services already provided, telephone usage, messaging usage, overages, phone numbers, and other consumed services are non-refundable.

If Stevendev Marketing agrees to a refund or service credit, the amount and form of that refund or credit will be determined based on the circumstances and any applicable written agreement.

13. Phone Numbers

Phone numbers supplied through our services may be provided by third-party telecommunications providers. Availability of a particular number is not guaranteed.

Porting, transferring, retaining, or releasing telephone numbers may be subject to carrier rules, account status, technical limitations, applicable fees, and legal requirements.

Unless otherwise expressly agreed in writing, Stevendev Marketing does not guarantee that a particular telephone number can be retained after service termination.

14. Appointments and Call Transfers

AI voice agents may schedule appointments, transfer calls, collect information, or perform other automated actions.

Customers are responsible for maintaining accurate schedules, contact information, transfer numbers, business hours, availability, and instructions.

Stevendev Marketing is not responsible for missed appointments, missed calls, unsuccessful transfers, incorrect scheduling, lost business opportunities, or similar consequences resulting from inaccurate customer information, third-party failures, telecommunications issues, or AI errors.

15. No Guarantee of Business Results

Stevendev Marketing does not guarantee any particular level of sales, leads, appointments, revenue, cost savings, customer acquisition, conversion rate, or other business result from using an AI voice agent.

Examples, demonstrations, projections, or descriptions of potential benefits are illustrative and should not be interpreted as guarantees of future performance.

16. Intellectual Property

The Stevendev Marketing name, branding, website content, graphics, software configurations, proprietary processes, prompts, templates, workflows, and other materials created by us are protected by applicable intellectual-property laws.

Customers retain ownership of their own business information, trademarks, content, and materials supplied to us.

Unless otherwise agreed in writing, purchasing our services does not transfer ownership of Stevendev Marketing's underlying technology, proprietary systems, templates, methodologies, or intellectual property.

17. Confidentiality

We will take reasonable measures to protect confidential business information provided to us in connection with our services.

Customers agree not to disclose or misuse confidential or proprietary information belonging to Stevendev Marketing.

These obligations do not apply to information that is publicly available, independently developed, lawfully obtained from another source, or required to be disclosed by law.

18. Privacy

Our collection and use of personal information are also governed by our Privacy Policy.

Customers using our AI voice agents to collect information from callers are responsible for maintaining an appropriate privacy policy and complying with applicable privacy and data-protection requirements.

19. Prohibited Uses

You may not use our website or services to:

• Violate applicable law or regulation
• Commit fraud or impersonate another person or organization
• Make unlawful calls or send unlawful messages
• Harass, threaten, or abuse others
• Distribute malware or malicious software
• Attempt unauthorized access to systems or data
• Interfere with the operation or security of our services
• Use our services in a manner that violates third-party rights
• Misrepresent the identity or capabilities of an AI voice agent where disclosure is legally required

We reserve the right to suspend or terminate service for prohibited activities.

20. Disclaimer of Warranties

To the fullest extent permitted by law, our website and services are provided on an "as is" and "as available" basis.

We make no warranties, express or implied, regarding uninterrupted operation, merchantability, fitness for a particular purpose, accuracy, reliability, or specific business results except where expressly provided in a written agreement.

21. Limitation of Liability

To the fullest extent permitted by applicable law, Repeat Customers LLC, Stevendev Marketing, and their owners, officers, contractors, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use of or inability to use our services.

This includes, without limitation, loss of revenue, profits, customers, business opportunities, data, goodwill, or anticipated savings.

To the fullest extent permitted by law, our aggregate liability arising from a claim relating to the services will not exceed the amount the customer paid to Stevendev Marketing for the specific service giving rise to the claim during the three months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so portions of this provision may not apply in every circumstance.

22. Indemnification

To the extent permitted by law, customers agree to indemnify and hold harmless Repeat Customers LLC, Stevendev Marketing, and their owners, officers, contractors, agents, and service providers from claims, damages, losses, liabilities, and reasonable expenses arising from the customer's unlawful use of the services, violation of these Terms, violation of third-party rights, or failure to obtain legally required permissions or consent.

23. Suspension and Termination

We may suspend or terminate access to our services for nonpayment, unlawful activity, abuse of our systems, material violations of these Terms, telecommunications-provider requirements, security concerns, or other circumstances that reasonably require suspension or termination.

Termination does not eliminate payment obligations incurred before termination.

24. Changes to These Terms

We may update these Terms periodically to reflect changes in our services, business practices, technology, or legal requirements.

The revised Terms will be posted on this page with an updated "Last Updated" date.

Continued use of our services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

25. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

To the extent permitted by applicable law and unless otherwise agreed in writing, legal proceedings arising from these Terms or our services will be brought in a court of competent jurisdiction located in Lubbock County, Texas.

26. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

27. Entire Agreement

These Terms, together with any applicable service agreement, order, proposal, invoice, Privacy Policy, or other written agreement between the customer and Stevendev Marketing, constitute the agreement governing the applicable services.

If a separately signed written agreement conflicts with these Terms, the signed agreement will control with respect to that conflict.
